In this action brought under the theory of Products Liability, the plaintiff was securing a vehicle to a car hauler when an S-hook broke and caused severe and permanent injuries. In the case against a major manufacture, Attorney Withey secured a settlement of $1,100,000.00, despite disputed liability. This case centered on the theory of negligence in the use of a toxic substance. The plaintiff suffered a sudden exposure to toxic chemicals at a refinery. Workers' Compensation - Power Press Case [Parties Confidential]
In an industrial setting, a worker was using a power press and was seriously injured. This case not only dealt with Personal Injury issues, but also Labor Law issues. Attorney Withey filed an action against the large employer under the Labor Code’s Section 4558. Rather than risk a trial, which Attorney Withey was more than willing to handle, the employer settled with the employee for $900,000.
Maria Jimenez v. Lam [Auto v. Bicyclist]
The Plaintiff in this case was riding her bicycle on the sidewalk and was hit by a car pulling into a driveway. The police report cited Plaintiff for being at fault. The insurance company denied her claim and 2 other firms turned down her case. Attorney Withey recovered the maximum policy limit for Plaintiff of $100,000.00, without filing a lawsuit.
Jackson v. Jan's Towing [Auto Accident]
Plaintiff recovered $220,000.00 [without a lawsuit] for a motorcycle accident involving a broken leg where the Defendant disputed liability.
